1. Acceptance of Terms

By accessing or using Nikagu ("the Platform"), operated at nikagu.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. We reserve the right to update these terms at any time, and continued use of the Platform following any changes constitutes acceptance of those changes.

2. Description of Service

Nikagu is a platform for discovering, rating, and charting AI-generated film and music content. The Platform provides community-driven rankings, creator verification, content submission tools, and educational resources related to AI-generated media. We serve as a directory and chart service — we do not host video or audio files directly.

3. User Accounts

To access certain features (voting, submissions, verification), you must create an account through our authentication system. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years of age to create an account.

4. Content Submissions

When submitting content to Nikagu, you represent and warrant that: (a) you are the original creator of the AI-generated content or have appropriate rights to submit it; (b) the content does not infringe upon any third-party intellectual property rights; (c) the content was generated using AI tools as disclosed in your submission; (d) the content does not contain harmful, illegal, or offensive material. All submissions are subject to review before appearing on the Platform.

5. AI-Generated Content & Intellectual Property

Nikagu acknowledges the evolving legal landscape around AI-generated content. Creators retain whatever rights they hold in their submitted works. By submitting content, you grant Nikagu a non-exclusive, worldwide license to display, embed, and reference your content (via YouTube or other hosting platforms) for the purposes of operating the chart and discovery service. You may request removal of your content at any time by contacting [email protected].

6. Voting & Chart Integrity

Users may rate and vote on content displayed on the Platform. Vote manipulation, including but not limited to creating multiple accounts to inflate ratings, using automated tools to cast votes, or coordinating inauthentic voting campaigns, is strictly prohibited and may result in account termination. Nikagu reserves the right to adjust chart algorithms to maintain fairness.

7. Creator Verification

The "Verified AI" badge indicates that a creator has demonstrated their content was produced using AI generation tools. Verification is granted at Nikagu's discretion and may be revoked if a creator is found to have misrepresented the nature of their content. Verification does not constitute an endorsement of content quality.

8. Prohibited Conduct

Users shall not: (a) submit content that infringes copyrights or trademarks; (b) attempt to manipulate charts or voting systems; (c) harass, threaten, or abuse other users; (d) use the Platform for any unlawful purpose; (e) attempt to gain unauthorized access to Platform systems; (f) scrape or collect data from the Platform without permission; (g) impersonate other creators or entities.

9. Rights Disputes

If you believe content on Nikagu infringes your intellectual property rights, please submit a dispute through our Rights & Disputes page or contact [email protected]. We will review all claims promptly and take appropriate action, which may include removing the disputed content from our charts pending resolution.

10. Limitation of Liability

Nikagu is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Platform, including but not limited to loss of data, revenue, or reputation. Our total liability shall not exceed the amount you have paid to us in the twelve months preceding any claim.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive.
